Welcome to Biteology (“Biteology,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of our website, services, and delivery operations (collectively, the “Services”).
By accessing or using Biteology, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you may not use our Services.

1. Overview

Biteology is an online food-ordering and delivery platform that allows college students to browse menus, place food orders, and have meals delivered to campus or designated delivery points.
These Terms apply to all users, including customers, visitors, and anyone interacting with Biteology’s website.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services.
By using Biteology, you represent that:

  • You are legally capable of entering into a binding contract.

  • All information you provide is accurate, complete, and up-to-date.

  • You are ordering food for personal, non-commercial use.

3. Account and Access

You may create an account to streamline ordering and delivery.
You are responsible for:

  • Maintaining the confidentiality of your login credentials.

  • All activity that occurs under your account.

If you suspect unauthorized access, contact andrew.boston@baynerinc.com immediately.
Biteology reserves the right to suspend or terminate accounts that violate these Terms.

4. Ordering and Payment

a. Placing Orders

When you place an order, you agree to:

  • Provide accurate delivery information (including dorm, address, and contact details).

  • Be available to receive your order at the scheduled time and place.

  • Pay all applicable fees and taxes displayed at checkout.

b. Payments

Payments are securely processed by third-party payment processors (e.g., Stripe).
Biteology does not store your full credit or debit card details.
By submitting payment, you authorize Biteology (and our payment partners) to charge your selected payment method for the total order amount.

c. Order Confirmation

An order is confirmed once you receive an email or on-screen confirmation.
All orders are subject to availability and acceptance by Biteology or its partner kitchens.

5. Delivery and Pickup

  • Biteology delivers food only within designated campus zones or nearby delivery areas.

  • Delivery times are estimates and may vary due to traffic, weather, or kitchen volume.

  • If you are unavailable to receive an order, Biteology may leave the order at the specified drop-off point or cancel it at your expense.

  • Once food is delivered, responsibility for the order passes to you.

6. Refunds, Replacements, and Cancellations

We strive for complete satisfaction, but due to the perishable nature of food, refunds are limited.

Refunds or replacements may be issued at our discretion for:

  • Orders that are never delivered.

  • Incorrect or missing items.

  • Orders canceled before preparation begins.

Refunds will not be provided for:

  • Late deliveries caused by weather or campus restrictions.

  • Failure to be present for delivery.

  • Personal taste or preference.

To request a refund or replacement, contact us within 24 hours at andrew.boston@bayerinc.com with your order number and issue description.

7. Food Safety and Allergens

Biteology and its partners handle food in shared preparation environments.
We cannot guarantee that menu items are free of allergens such as nuts, gluten, soy, dairy, or other ingredients.
Users with allergies or dietary restrictions should exercise caution and contact us before placing an order.

8. Promotions and Discounts

Occasionally, Biteology may offer promotional codes, discounts, or referral incentives.
These offers are subject to expiration, limited availability, and additional terms.
Biteology reserves the right to modify or cancel promotions at any time.

9. Acceptable Use

When using our website or Services, you agree not to:

  • Violate any laws or regulations.

  • Provide false or misleading information.

  • Interfere with or disrupt the security of our platform.

  • Copy, scrape, or resell content from Biteology without written consent.

  • Engage in abusive, harassing, or fraudulent activity.

Any misuse may result in immediate suspension or permanent termination of your account.

10. Intellectual Property

All trademarks, logos, graphics, menus, photos, and website content are the exclusive property of Biteology or its licensors.
You may not copy, reproduce, distribute, or modify any content without prior written permission.

11. Third-Party Services

Our platform may include integrations with third-party providers (e.g., Stripe, Google Analytics, delivery partners).
We are not responsible for their content, policies, or actions.
You should review their respective terms and privacy policies before interacting with their services.

12. Disclaimers

  • “As Is” Basis: Biteology provides the Services as is and as available.

  • No Warranty: We make no guarantees regarding the accuracy of menus, delivery times, or the continuous availability of the platform.

  • Allergens & Dietary Restrictions: We are not liable for adverse reactions caused by undisclosed ingredients or preparation errors.

To the fullest extent permitted by law, Biteology disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law:

  • Biteology and its affiliates are not liable for indirect, incidental, consequential, or punitive damages.

  • Our total liability for any claim arising from your use of the Services shall not exceed the total amount you paid for the order giving rise to the claim.

Some jurisdictions do not allow limitations of liability, so certain provisions may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Biteology, its employees, contractors, and affiliates from and against any claims, losses, damages, or expenses (including attorney fees) arising from:

  • Your use or misuse of the Services,

  • Violation of these Terms, or

  • Infringement of third-party rights.

15. Suspension or Termination

Biteology reserves the right to suspend or terminate access to its Services at any time, without notice, for violations of these Terms or misuse of the platform.

16. Governing Law

These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict of law principles.
Any disputes shall be resolved exclusively in the state or federal courts located in Boston, MA.

17. Modifications to These Terms

We may update these Terms from time to time.
When we do, we’ll post the updated version on this page with a new “Effective Date.”
Continued use of Biteology after updates constitutes acceptance of the revised Terms.
